Agreement

Article 1. Adoption

YOMOYAMA Inc. has established the following Terms of Use for the use of “NINGINE” provided by the Organization. Users of this service shall use this service after agreeing to these Terms of Use in advance.

Article 2. Contents of this service

As part of the Service, YOMOYAMA Inc. provides users with the function to post reviews, comments, etc., and vote on others’ postings, as well as the reviews, comments, etc. posted by users using these functions. However, YOMOYAMA Inc. reserves the right to change, suspend all or part of the Service, or discontinue the Service without prior notice.

Article 3. No Warranty on this Service

1. Use of this service is at the user’s own risk. Responsibility for the content of the posts by users is assumed by the users themselves. Therefore, please note that we assume no responsibility on behalf of the user.
2. YOMOYAMA Inc. does not guarantee the accuracy, timeliness, legality, completeness, usefulness, or any other aspect of the content of the posts. Users use the content at their own risk and discretion. YOMOYAMA Inc. will not be held liable for any damages incurred by users or problems between users in connection with the use of the posted contents or external websites to which links have been set.
3. This service does not guarantee the permanent storage or publication of the contents of posts by users.
4. YOMOYAMA Inc. shall not be liable for any damages incurred by users in connection with the Service. In addition, as stipulated in the proviso of Article 2, the Service may be changed, suspended, discontinued, or terminated without notice, and the Company shall not be liable for any damages incurred by users in connection with such changes, suspension, discontinuation, or termination.

Article 4. Regarding the posting and deletion of written content

1. The content of users’ posts will be posted only after approval by YOMOYAMA Inc.
2. Users may not post any content that falls under or is likely to fall under any of the following categories. In the event that any content is posted that falls under or is likely to fall under any of the following grounds, the Company may delete the content without notice to the user. Also, please note that even in the event that the following reasons do not apply or are not likely to apply, we may have no choice but to delete the posted content at our discretion for the purpose of managing this service.

1. Content that deviates from the purpose of this service
2. Content that contains computer viruses or other harmful programs or scripts
3. Content that infringes on the rights or interests of others, including copyrights, moral rights, trademarks, and other intellectual property rights, and privacy rights
4. Content of posts that defame others
5. Content of posts that cause credibility concerns, such as damage to the reputation of a specific business without evidence
6. Contents of posts that lead to or encourage crimes, such as criminal threats and instructions to commit crimes.
7. Content of posts that violate laws and ordinances or public order and morals
8. Sexually repulsive content of posts
9. Content that leads to or encourages serious risky behavior
10. Content of posts offering to sell or transfer for profit or personal use
11. Content of posts involving promotional activities
12. Content that has been diverted from other parties’ websites, books, magazines, advertisements, or other media without permission.
13. Content of posts that post the same content multiple times
14. Content posted for the purpose of receiving compensation, such as money or goods, from a third party
15. Content that interferes with or disrupts this service or our services, or content that is posted due to an act that interferes with or disrupts this service or our services
16. False written content
17. Content that constitutes obscene material or child pornography
18. Content of posts promoting prostitution/prostitution
19. Content that promotes the use of stimulants, narcotics, or other drugs
20. Content of posts that deceptively use another person’s name
21. Content that encourages youth to drink, smoke, gamble, etc.
22. Content that is intended for unhealthy encounters, or content that encourages or leads to such encounters.
23. Content of posts containing personal or contact information for the purpose of unhealthy encounters
24. Other content or actions that the Company deems inappropriate.

3. Whether or not a post is subject to action based on the preceding paragraph shall be determined entirely at the discretion of the Company, and the Company shall not disclose any reason for any action taken by the Company, even if requested by the user. Please be aware that we will not delete any posted content, even if requested to do so by the user who posted it, except in the case of posts that violate these Terms of Use or under other special circumstances.

Article 5. Copyright

1. When a user posts content on the service, all copyrights (including the rights stipulated in Articles 27 and 28 of the Copyright Act) such as reproduction rights, public transmission rights, transfer rights, translation rights, and adaptation rights in Japan and abroad of said content, and other rights under the Copyright Act (including the right to sublicense from the Company to a third party) are granted. All other rights under the Copyright Act (including the right of sublicensing from the Company to third parties) The user shall be deemed to have granted the Company a free of charge license to use such rights.
2. Users agree not to exercise their moral rights of authorship against the Company and those who have succeeded to or been granted rights by the Company.

Article 6. About this Agreement

These Terms of Use are subject to change without notice. Any changes shall become effective immediately upon posting on the Company’s website.

Article 7. Governing Law and Court of Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.

The Tokyo District Court shall have exclusive jurisdiction in the first instance over any and all disputes arising out of or in connection with these Terms and Conditions.
